This Liability Waiver and Rules ("Agreement") is made and entered into as of [Date] by and between [Your Business Name], a [State of Incorporation] corporation with a principal place of business at [Your Address] ("Contractor"), and [Client Name], residing at [Client Address] ("Client").

 

1. Services

Contractor agrees to provide biohazard remediation and restoration services at the property located at [Property Address] ("Property") on the following terms and conditions:

  • A detailed description of the services to be provided will be attached as Exhibit A and incorporated by reference herein.

2. Client Responsibilities

  • Client warrants they have the legal authority to enter into this Agreement and grant Contractor access to the Property.
  • Client agrees to cooperate with Contractor and provide all necessary information regarding the incident at the Property, including the nature of the incident and the involvement of law enforcement (if applicable).
  • Client will vacate the Property during the cleanup process unless otherwise authorized by Contractor due to safety concerns or the need for specific information from the Client.
  • Client acknowledges the inherent risks associated with biohazard remediation, including potential exposure to pathogens and the possibility of property damage exceeding initial estimates due to the unforeseen nature of biohazards.

3. Risk of Loss

The Property and its contents are at Client's sole risk from the time Contractor arrives on-site until the project is completed. Contractor is not responsible for any loss or damage to the Property or its contents caused by:

  • Pre-existing conditions at the Property, such as structural damage, mold growth, or pest infestations.
  • The nature of the incident itself (e.g., fire damage, water damage).
  • Acts of God or other unforeseen circumstances beyond Contractor's reasonable control.

4. Client Release of Liability

In consideration of the services to be provided by Contractor, Client hereby releases and forever discharges Contractor and its employees, agents, and representatives from any and all claims, demands, or causes of action of any kind, whether known or unknown, arising out of or related to the biohazard remediation and restoration services performed at the Property.

This release includes, but is not limited to, any claims for:

  • Property damage caused by the incident or the cleanup process, exceeding initial estimates as outlined in Section 2.
  • Personal injury or illness arising from exposure to biohazards.
  • Emotional distress.
  • Economic loss.

5. Rules

  • Client agrees to comply with all safety rules and instructions provided by Contractor during the cleanup process.
  • No smoking or open flames are permitted on the Property while the work is being performed.
  • Client agrees not to remove or tamper with any biohazard containment measures put in place by Contractor.
  • Client agrees to promptly notify Contractor of any pre-existing conditions at the Property that may pose a safety hazard or complicate the cleanup process.
  • Contractor reserves the right to refuse service or terminate this Agreement at any time if Client fails to comply with these rules or otherwise interferes with the safe and efficient completion of the project.

6. Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [Your State].

8. Binding Effect

This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective successors and permitted assigns.

9. Severability
